Indiana high court to hear arguments in David Camm case

LOUISVILLE (WAVE) -- The Indiana Supreme Court will allow oral arguments in the appeal of David Camm, convicted twice of killing his wife and their two children. WAVE 3's Connie Leonard reports that Thursday's developments have many asking could Camm now get a third trial?

Camm's attorneys certainly think there could be a third trial, but Floyd County, Indiana prosecutor Keith Henderson tells me don't bet on it.

Henderson says he's not surprised at all by the decision. He says he expected the court would want to hear arguments because it was such a lengthy and important case and Camm was given life without parole.

Two trials have already been held costing Floyd County some $2-million. Each time, Camm was convicted for the September 2000 murders of his wife, Kim, and children, Brad and Jill.

Camm's defense attorney Kitty Liell says Henderson made a mistake by telling the most recent jury that Camm killed his family because his wife found out he molested his daughter. An appeals court warned prosecutors to be careful about that accusation.

But Henderson contends the trial was clean and says the judge was very careful about deciding what to let in.

"I felt good then. I feel good now. And I'm confident that the Indiana Supreme Court will give the case a thorough review and there's nothing that gives me cause for concern," said Henderson.

"Now that the case is fully briefed before the Supreme Court, we feel very confident this is one more step further in the direction to freeing Dave Camm," Liell said during a telephone interview.

Liell says her defense team will work with top legal scholars to prepare for their presentation. Prosecutors will work with the Indiana Attorney General's office.  The oral arguments will take place May 22 in Indianapolis.
