WAVE 3 TV Louisville, KY | Judge tells attorneys in murder case to work with each other after lead detective retires

LOUISVILLE, KY (WAVE) - Two murder suspects were in court for a pre-trial conference Thursday. Wilbur Mucker III and Keath Tyson are charged with killing Gerald Garner in April 2009 at his home while he slept.
They are both scheduled to stand trial in February, but the case appears at a stalemate.
The two men also face charges for robbery, burglary and tampering with evidence. During Thursday's pre-trial conference, attorneys on both sides said they're having trouble getting evidence from the police and state crime lab.
Part of the problem is that the lead detective in the case retired. The victim's grandmother, Queen W. Swope, hopes that doesn't prevent justice from being served.
"I hope they can find the right person who killed my grandson," Swope said. "He was my only grandson. A very nice person."
The judge ordered the attorneys to work with each other to get the information and scheduled another conference to check on their status.
Both Mucker and Tyson remain in custody.
After Thursday's court proceedings, a fight broke out between the victim and defendant's family members. Sheriff deputies quickly broke it up.
