Brent Burke murder trial delayed

LOUISVILLE, KY (WAVE) - A double murder trial in Hardin County may be over before it starts. WAVE 3 News has confirmed that attorneys for Brent Burke have asked for a mistrial to be declared.

The request is based on defense claims that the prosecution withheld some evidence until last week. Included in that evidence are interviews conducted by Kentucky State Police in which a teen tells investigators that another boy confessed to killing 31-year-old Tracy Burke and her ex-mother-in-law, 53-year-old Karen Comer on September 11, 2007. Burke has pleaded not guilty to the murders.

Jury selection in the case has been suspended. The judge is expected to issue his ruling on Monday which could result in a mistrial or delay.
