PADUCAH, KY (WAVE) - A hearing is going to be held to determine the mental competency of the Heath High School shooter Michael Carneal.
US District Judge Thomas Russell turned down a request by prosecutors to halt a February hearing in the case of Carneal.
Prosecutors say recently discovered letters from Carneal show that he was aware of his mental illness before he made an appeal to challenge his guilty plea, but Carneal's appeal was made too late.
Carneal admitted to killing 3 classmates and wounding five others in December of 1997 at Heath High School near Paducah.
Carneal, now 27 years old, is serving life in prison and will be eligible for parole in 2023.
