LOUISVILLE, KY (WAVE) - The sentencing hearing for a convicted sex offender who pled guilty to murdering a 4-year-old boy begins later today.
Judge Judith McDonald-Burkman will decide whether Cecil New gets life in prison or death for killing Ivan Cano in 2007.
Ivan Cano was last seen on June 29, 2007, playing outside his family's apartment near Churchill Downs. More than a week later, sanitation workers found his body in the back of a garbage truck. That same year, Louisville Metro Police officers arrested New and charged him with murder, kidnapping, tampering with physical evidence and unlawful transaction with a minor.
New's jury trial was set to begin October 15, but the day before it started he made an unexpected open plea of guilty to all the charges. New's defense attorney cited the media attention.
We spoke with Ivan Cano's mother, Rosalina, over the phone Sunday night. When she was asked whether she wanted New to receive the death penalty or life in prison, she paused then said she is leaving that decision up to the judge.
Rosalina says she does not want another family to suffer.
