LOUISVILLE, KY (WAVE) - Tuesday was an emotional morning in court during day two of Cecil New's sentencing hearing. New pleaded guilty last month to kidnapping and killing 4-year-old Ivan Cano in 2007, and is eligible for the death penalty.

Judge Judith McDonald-Burkman will decide if he'll get life in prison or the death penalty. On Tuesday New's siblings and mother took on the stand. They're talking about some of the factors the judge should consider before making her sentencing ruling.

One of New's sisters described their childhood growing up with an abusive father who she said was an alcoholic and beat them every day. She said Cecil New often took the beatings for his siblings.

New's mother, who is not being identified, apologized to Cano's family.

"I'd like to tell them all I'm sorry for the things that happened to their son. I wish it had never happened, and I hope you will all forgive us. I'm really sorry for what happened," she said.

New, who has shown little emotion throughout his court appearances, at times wiped away tears as his family talked about his childhood.

On Monday, an LMPD detective talked about the moment they recovered Cano's body from a garbage truck.

The defense was expected to call nine witnesses before wrapping up its case. McDonald-Burkman set the sentencing date for Dec. 14.
