LOUISVILLE, KY (WAVE) - A teen and his mom accused of badly beating a Louisville cancer patient appeared back in court Thursday, December 9 for an update on their case.

In the midst of the case came a new revelation involving 16-year-old Michac Jones.  Only WAVE 3 News was there to learn that in addition to assault in that case, Jones is facing even more cruel charges unrelated to that beating back in May.

"He's got an addition charge that's unrelated to the assault case.  What we have here is Mr. Jones is charged with a rape of a child under 12 and then on a different day, there's an incident where the assault charges take place," said David Scott with the Commonwealth Attorney's Office.

Details about the rape charge are few, due to the sensitivity of the case and the juvenile age of both Jones and the victim.

Thursday morning, Jones appeared with his mom on the assault charges centering around Carl Berry.

Already in pain from cancer, Berry also suffered a swollen head, shattered eye socket, facial fractures, and broken ribs from being kicked several times.

Surveillance video from a Louisville Dollar General store back in May shows everything unfolding.
Jones's attorney fires back, saying that Michac was provoked after being verbally attacked.

His mom -- Renica Jones -- is facing less-severe charges of tampering with a witness in the beating case.

The two are expected back in court for another status hearing early in 2011.  The rape case involving just Michac is still pending.
