Driver in fatal crash on Greenbelt Highway charged with murder

LOUISVILLE, KY (WAVE) - Louisville Metro Police say the driver of a car that crashed on Greenbelt Highway early Sunday was drunk, and he's now charged with murder after his passenger died from her injuries.

Officers from LMPD's Traffic Unit arrested 26-year-old Francisco Balderez Sunday in connection with the fatal crash that happened on Greenbelt Highway around 8:45 a.m. 

Police say Balderez was driving a BMW when he lost control, swerved off the road and struck a utility pole. The car ended up in a ravine. His passenger, 40-year-old Martha Diaz," was pronounced dead at the scene. She was not wearing a seatbelt.

Balderez, from Fort Knox, KY, is now charged with murder, criminal mischief, DUI and possession of a controlled substance.

Earlier reports indicated that Balderez was wearing a seat belt, but police now say he was not. 

Balderez was due to appear in court on Monday.
