LOUISVILLE, KY (WAVE) - The fight over the JCPS assignment plan is headed to the State Court of Appeals. On behalf of nine families, Louisville attorney Ted Gordon filed a motion asking for the State Court to overturn a ruling made by Jefferson Circuit Judge Irv Maze.
In August, Judge Maze threw out a lawsuit filed by 13 families. Gordon said this legal battle boils down to the exact meaning of the words "enroll and attend" in the assignment policy.
