Former UofL nursing student lawsuit ruling 'improper'

LOUISVILLE, KY (AP) - A federal appeals court has overturned a decision to reinstate a University of Louisville nursing student expelled over blog posts about an assignment to follow a woman the day she gave birth.

The U.S. 6th Circuit Court of Appeals on Monday sent the case of Nina Yoder back to federal court in Louisville.

Yoder sued the school in 2009, saying she was improperly dismissed because of her blog. Yoder mentioned the school in the blog, but never gave the names of patients. U.S. District Judge Charles Simpson ruled in August 2009 that the school violated a contract with Yoder.

The three-judge appellate panel ruled that Yoder's lawsuit raised free speech issues, but not a contract violation, so Simpson's ruling was improper.
