LOUISVILLE, KY (WAVE) - The family of a 9-year-old hit and run victim says he is in critical condition at Kosair Children's Hospital with a head injury and collapsed lung.
His mother told WAVE 3 she's frustrated with the police investigation. The 16-year-old who was wanted in connection with the crash turned himself into police on Thursday. He was questioned but then released from police custody.
"He is shaking. He cannot control his nerves. His brain injury is pretty bad," the victim's mother said.
Last Saturday morning her kids were rushed to Kosair after their car was hit in the 6500 block of Six Mile Lane. A week later, orange paint marks the spot of where it happened. Police say a 16-year-old in a rental car lost control and over-corrected. They say he took off after the crash, but Thursday he turned himself into police.
"I was very happy to see someone come forward, said they did it, but I'm not very happy they released him," the victim's mother told us.
The detective on the case told us over the phone on Sunday, they're still waiting to talk with the juvenile's attorney so right now they're stuck between a rock and a hard place.
"I think they need to hold him because my child can't go home for the weekend. My child cannot go home and lay in his bed. We can't hug him. We can't kiss him. All we have is his hand to love on," the 9-year-old's mother said.
Police say they plan to talk with the juvenile's lawyer Monday morning.
