The man accused of killing his 2-year-old son was in court Tuesday morning.
Antrone Smith, 29, was indicted for aggravated murder, murder and felonious assault in the death of Damarcus Jackson. He was arraigned on these charges in Judge Andrew West's court room.
Smith's bond remained at $500,000 and a pretrial hearing was set for Dec. 1.
Prosecutors are seeking the death penalty against Smith.
Smith's sister, Tabitha Smith-Moran was in the courtroom on Tuesday. She says that he is a good person and does not deserve to die.
"You have other cases out here where people have left their kids in a car to die and people who shoot their kids and things like that? Have they gotten the death penalty? No," she said.
She added that Smith would never do anything to harm his kids.
Smith's mother, Florence Smith, said she wasn't home when Damarcus was hurt.
"I don't know what happened and I'd like to know. As a grand mother and as a mother, I would like to know," she said. "My grandson is gone and I'm about to lose my son. The only thing a mother can do is pray."
Damarcus' mother, Latricia Jackson, 22, is charged with child endangering in connection with his death. She being held at the Hamilton County Justice Center, awaiting her arraignment on Nov. 3.
