Former police officer accused of making racial slur appeals ruling

NEW ALBANY, IN (WAVE) - New Albany police officer accused of making racial comment will get his day in court. Officer Jack Messer was suspended back in 2010 for making a sarcastic remark regarding Civil Rights during roll call. 

The New Albany Police Merit Board also found that Messer has abused his sick leave. 

Now retired from the department, Messer is appealing the ruling of the Merit Board.

Messer claims that his remarks were protected by the First Amendment. The Indiana Court of Appeals will hear the arguments February 8 at Silver Creek High School. The Public is invited to attend.

The Court of Appeals is responsible for hearing arguments in Indiana to help citizens learn more about the Judiciary's role in Indiana government.
