LOUISVILLE, KY (WAVE) – A court case that involved a UofL Assistant Coach, an Oldham County Magistrate and angry Kentucky Derby ticket buyers that was dismissed is now being looked at again, because all the actions took place in the same city.
Scott Davis, a Former Oldham County Magistrate, claimed he gave $70,000 to Steve Massielo, a former UofL Assistant Coach, to garner Derby tickets for Davis' ticket business, SMD Enterprises in southern, Indiana.
A judge previously ruled the contract in Indiana did not apply in Kentucky and dismissed the case as Davis tried to get back some $50,000 he gave to Masiello.
Thursday, Davis' attorney told the appellate judges that everything happened in Louisville.
Davis' attorney also argued the UofL and Massielo's celebrity had nothing to do with the case.
Massielo said he merely gave the money to a man named Steve Netherton and it was Netheron who did not deliver the tickets. Massielo also said he actually lost $20,000.
The judges will make a decision as to whether Davis has a case to go after Massielo in court for the $50,000.
