Driver on home incarceration when police say he hit, killed little girl

LOUISVILLE, KY (WAVE) – The driver who police say hit and killed a young girl on Monday was on home incarceration at the time of the crash.

Michael Penick, was also driving on a suspended license when he hit 7-year-old Aiyana Osburn on Buechel Bank Road. Aiyana died while in surgery at Kosair Children's Hospital.

Because Penick was on home incarceration, he was only allowed to leave his house to attend classes at Brown Mackie College.

According to an arrest report, Penick did not go to school that day and did not have permission to be in the area where Aiyana was hit.

Penick was arrested Tuesday afternoon and charged with second degree escape and theft by failure to make required disposition of property. He was arraigned Wednesday morning.

Penick is being held at Metro Corrections. Police say toxicology reports are pending in the case.
