Former teacher claims firing was due to fertility treatments

FORT WAYNE, IN (WAVE) – An Indiana teacher is suing claiming fertility treatments cost her her job.

Emily Herx filed a lawsuit against the Fort Wayne-South Bend Diocese.

Herx was fired from her job last June while she was undergoing in vitro fertilization.

The Roman Catholic Church has taken a strong stance against the procedure and have said in vitro fertilization leads to the destruction of embryos.

Herx shared her story on the TODAY show and said, "For two years my supervisor had known about it and said she was praying for us so there was no warning, there was nothing. So in my heart I had support and I was being honest about it."

Legal experts said the case presents a challenge for the courts where the separation of church and state has not been clearly defined.
