Public Defender's Office finds itself in unusual conflict of interest

LOUISVILLE, KY (WAVE) - The Public Defender's Office will withdraw from representing a Louisville mother accused of trying to kill the man who was later charged with murdering her son.

It's a bizarre turn of events because Kendra Wilson is charged with the attempted murder of James Mallory, a man who's been a central figure in several violent crimes.

"They won't be able to represent her because they represent James Mallory," said Asst. Commonwealth Attorney Erin White.

Mallory is charged with killing Wilson's son, Gregory Holt, who was seemingly gunned down for no reason in his Cloverdale apartment April 11. But Louisville Metro Police said Wilson tried to kill Mallory the day before Gregory, a Farnsley Middle School student, was gunned down.

"James Mallory is obviously the victim in her case as she's indicted for his criminal attempted murder, robbery and assault," White told WAVE 3.

Both were represented by the Louisville-Jefferson County Public Defender's Office. Mallory and Wilson are witnesses in their respective cases. Therefore, there's a conflict of interest. It's a situation the prosecution admits, is rare.

"We don't have that many cases that are so intertwined and that are so closely related both, in time, because everything happened within about 18-to-24 hours and the players," White said.

Police said Wilson was involved in the attempted murder of James Mallory in April. Two other men in the case, William O'Bannon and Brandon Bartee, have taken plea deals.

Wilson remains in custody at Louisville Metro Corrections. She is being held on a $500,000 bond.
