LOUISVILLE, KY (WAVE) – A constable
charged with shooting a suspected shoplifter rejected a plea deal.
On Thursday Constable
David Whitlock turned down a plea deal offered to him by prosecutors.
Whitlock is charged with
shooting a suspected shoplifter, Tammie Ortiz, at the Walmart in Pleasure Ridge
Park in November 2011.
If Whitlock had taken the
deal and pleaded guilty to assault under extreme emotional disturbance he would
have gone into a diversion program, resulting in no jail time. As long as he followed the
rules the current charged would be dropped. However, it would also
mean he couldn't serve as a constable.
Now that Whitlock has
rejected the deal the case will go to trial.
No word yet on when that
trial will begin.
