FLORENCE, KY (FOX19) -
The Kentucky Board of Medical Licensure has suspended the medical license of Florence doctor Gary Shearer after finding that 15 patients died while in his care.
Dr. Shearer is a family doctor with offices located on Turfway Road.
In 2011, the Kentucky Attorney General ran an inquiry on the top five prescribers of Oxycodone in central and eastern Kentucky, and found Shearer to be on of those prescribers. The Office of the Inspector General requested a prescriber review to identify any issues with his prescribing patterns and to identify patients for whom inappropriate prescribing may have occurred.
An investigator with the Drug Enforcement and Professional Practices Branch of the Office of the Inspector General referred 20 patient names for further review to determine appropriate medical care. The Board of Licensure then subpoenaed records for 15 of the 20 patients.
A Board consultant found that Shearer departed from or failed to conform to acceptable and prevailing medical practices in 10 of the charts reviewed. The consultant found that "the licensee's lack of quality follow up on a monthly basis for continuation of care constituted gross negligence."
In April of 2012, the FBI raided Shearer's office, seizing all of the patient charts and 313 blank prescriptions that had been pre-signed.
In June, the Board reviewed information regarding the deaths of 15 patients to died at the same time they were being prescribed controlled substances. The deaths occurred between 2009 and 2011.
Dr. Shearer's license has been suspended immediately and is prohibited from performing any act which constitutes the practice of medicine.
