LAS VEGAS (FOX5) -
A confrontation between two men at a Las Vegas gas station resulted in one of them spraying the other with fuel and lighting him on fire, police said Monday.
According to Las Vegas Metro police, Patrick Newell, 61, was charged in connection to the incident that critically injured Theodore Bejarano.
Police said the incident happened at the Circle K in the 9400 block of Las Vegas Boulevard South on Oct. 10.
According to a Metro police arrest report, Bejarano was drinking inside the convenience store. A clerk told him he couldn't drink in the store and asked him to stop. When Bejarano refused to quit, he was asked to leave.
As Bejarano left the store, Newell entered and paid for gas, according to the report.
When Newell left the store, he found Bejarano leaning against his vehicle, which was parked at a gas pump, according to Metro. Detectives in the report said Bejarano asked Newell for a ride. Newell said he couldn't give Bejarano a ride because he was driving a business vehicle.
Bejarano continued asking for a ride, and Newell became annoyed, telling Bejarano to leave him alone, police said.
It was then that Newell threatened to cut Bejarano with a small pocket knife, if he refused to leave the area, police said.
Newell went back in the Circle K and told the clerk that Bejarano was drunk and harassing him. He asked the clerk to call police. He then returned to his truck.
The report said the clerk went outside and asked Bejarano to leave, before going back inside to call police.
As Bejarano approached the driver's side of Newell's vehicle, Newell removed the gas nozzle from his tank and sprayed gas on Bejarano's shirt and face, according to police. Police said Bejarano walked away, wiping his face as Newell again asked him to leave.
According to Metro's report, Bejarano approached Newell again, mumbling something about ruining his shirt. Police video appears to show Newell again spraying Bejarano and pushing him to the ground, the report states.
Newell pulled a lighter from his pocket and showed it to Bejarano. When Bejarano refused to leave, Newell lit his shirt on fire, according to Metro.
Newell began to scream and stripped off his shirt and shorts, according to the report.
Police said a witness to the incident approached and told Bejarano to drop to the ground and roll.
Bejarano was transported to University Medical Center and treated for second degree burns on 10 to 15 percent of his body, mainly on his left side and both arms. According to an arrest report, he also suffered damage to his lungs due to inhalation of the flames.
Newell's charges include attempted murder with use of a deadly weapon, battery with use of a deadly weapon resulting in substantial bodily harm, and assault with a deadly weapon.
