Zoo train derailment lawsuit to move forward

LOUISVILLE, KY (WAVE) – A lawsuit against the Louisville Zoo will move forward.

Judge Fred Cowan refused to throw out a lawsuit against the Louisville Zoo concerning the 2009 train derailment filed by passengers who were injured.

However, Judge Cowan did agree that Metro Government, which owns and operates the Zoo, cannot be sued.

A state investigation found the driver of the zoo train had inadequate training and that the train was speeding and poorly maintained.

The train derailment sent 17 children and five adults to the hospital on June 1, 2009.

The lawyers for the plaintiffs said the ruling was a victory for them. More on the lawsuit is expected to be decided Wednesday morning.
