Former constable awaiting restitution fees

LOUISVILLE, KY (WAVE) - The former constable who shot an alleged shoplifter is waiting to find out how much restitution he could pay.

David Whitlock took a plea deal, meaning he cannot serve in law enforcement. He was also placed on probation.

Whitlock shot Tammie Ortiz in November 2011 in a WalMart parking lot in Pleasure Ridge Park.

The Commonwealth is asking for $3,000 in restitution for damages to Ortiz's vehicle.

Whitlock's attorney argued Ortiz no longer owns the SUV involved in the case and the vehicle could be fixed for less.

Ortiz filed a civil suit against Whitlock and Walmart.
