NEW ALBANY, IN (WAVE) - A grandfather arrested on assault and drug charges appeared in court.

James Ross had an outstanding warrant for possession of marijuana.

Early Sunday, police were called to his home after his 14-year-old grandson alerted relatives Ross had allegedly choked him and he feared for his life.

The SWAT Team got involved in the claim because police knew Ross had guns in his home.

Thursday, Ross' lawyer, Michael McDaniel, said Ross was not doing anything illegal and that he is a member of the Floyd County Coon Hunters, "These are weapons he has collected."

McDaniel said Ross and his grandson were arguing because the teen was smoking.

Marijuana was found in the home. McDaniel said he wants to see the police report to see who the pot belonged to.
