Testimony underway in day 2 of love-triangle murder trial

LOUISVILLE, KY (WAVE) - Day two of testimony in the murder trial of Joseph Banis is underway.

Lead Louisville Metro Police Detective Jon Lesher was the first on the stand Tuesday morning for cross-examination by the defense attorney. He questioned Lesher about the experience in homicide he had in June 2010 when he was assigned to investigate the death of Jamie Carroll.

LMPD found Carroll's body in the basement of an Old Louisville home after they say Banis told them it was in the house. He was taken into custody that same day after police were called to a domestic dispute between Banis and his boyfriend Jeffrey Mundt.

Prosecutors say Carroll was shot and stabbed in December 2009 after a night of having sex and doing meth with Banis and Mundt. The men are accused of stuffing Carroll's body into a 50-gallon Rubbermaid bin then burying it the basement.

Prosecutors said the two men plotted to steal Carroll's drugs and money. Banis' attorney told jurors Mundt killed Carroll out of jealousy after he found Banis and Carroll having sex that night.

Banis' attorney argued Banis told police about the body to turn in his boyfriend. Prosecutors said they believe Banis told police to get a deal.
