Father guilty in toddler's murder, won't face death penalty

A Hamilton County jury has convicted a father of murder and felonious assault in the death of his 2-year-old son.

Antrone Smith killed Damarcus Jackson in 2011.

Smith was charged with aggravated murder, but the jury found him not guilty on that charge, meaning he cannot be sentenced to death.

Smith's defense attorneys claimed that Smith didn't intentionally cause the child's death.

Jackson was in foster care, but returned to his biological parents just two months before he died.

Jackson had numerous injuries to his left jaw, left eye, legs, arms and midsection. There were also lacerations above his penis, on the back of his neck, above his left ear and on his left buttocks. He also had an untreated burn on his right hand.

The coroner ruled that Jackson died of blunt force trauma to his abdomen. He had severe internal bleeding and his injuries were consistent with being stomped on.

Smith will be sentenced on April 9, 2013. He faces a mandatory 15 years to life in prison.
