FRANKFORT, KY (WAVE) - Two out of five charges fined for texting while driving have been thrown out by Jefferson County judges.
Police and prosecutors said the ban, which has been in place for two years, is nearly impossible to enforce in Kentucky.
More than 900 charges have been brought across the state so far.
A review by the Courier Journal found a fourth of those charges were dismissed, while there were convictions in about three out of five of the cases, a much lower rate than in other legal areas.
