District to appeal ruling on use of bond money

Posted: Updated:
PHOENIX (AP) -

A suburban Phoenix school district plans to appeal a court ruling overturning a 2010 state law allowing school districts to spend unused bond money without asking voters.

Cave Creek Unified School District's superintendent says they plan to ask the Arizona Supreme Court to overturn last month's appeals court ruling.

The Goldwater Institute sued the district to stop its planned use of $13 million left over from a $41 million bond approved in 2000.

The 2010 law allowed school districts to spend excess bond money for purposes not authorized by voters.

Superintendent Debbi Burdick said in a letter to parents Thursday the district wanted to expand the cafeteria at Cactus Shadows High School, replace school air conditioners and buy new buses.

The high court does not have to accept the appeal.
