TOLEDO, OH (Toledo News Now) -

One of five men charged with the death of a local gym owner appeared in court Tuesday at 9 a.m.

Chad Brown and his attorney agreed to a plea deal.

Police say Brown and four other men had a hand in the shooting death of 57-year-old Intensity Crossfit Gym owner Joseph Lengel.

Brown, 35, turned himself into police.

Brown has agreed to plead guilty to involuntary manslaughter and aggravated robbery with a gun.

He could face three to 11 years for the robbery charge, with an additional three years for the gun charge.

During court on Tuesday, the judge said Brown was not present during the shooting of Lengel, but he played a part in planning the robbery, got the get-away car, and agreed to split money and marijuana after the robbery with the other suspects.

Tuesday morning, Brown's attorney asked a judge to drop the gun charges against his client.

The court will not allow it.

Matthew Managhan, 34, was arrested and charged with aggravated robbery in relation to the crime. Managhan also accepted a plea deal.

Both Managhan and Brown will be sentenced on April 30, at 1:30 p.m.

Jason Kuhns, 31, of Toledo, has been charged with aggravated murder, aggravated robbery with a deadly weapon and complicity.

Devonte Harris, 19, of Toledo, has been charged with aggravated murder and aggravated robbery with a deadly weapon.

Early on in case, all four men asked the court for immunity, being that a fifth suspect, Deitrekk Boone, is still on the loose, and they claim he is the one who pulled the trigger.

Police are still searching for Boone, 19, and he is considered one of Ohio's most dangerous fugitives.

Anyone who knows anything about his whereabouts should call CrimeStopper at 419-255-1111.

Lengel was shot outside the gym just before 6 a.m. on Nov. 19. He later died at a hospital. On the day of the crime, police said it  appeared to be an attempted robbery gone wrong. The coroner's report concluded that he died of a single gunshot wound to the side.
