Toby Keith's I love This Bar lawsuit dismissed

CINCINNATI, OH (FOX19) -

The Banks developers say a dispute with Toby Keith's I Love This Bar & Grill involving unpaid rent has been resolved.

A lawsuit was filed in February against the owner of Toby Keith's, claiming the bar, owned and operated by Capri Concepts, LLC, was $231,980 behind on rent, taxes and utilities.

The bar's lawyer claimed they initially signed an exclusivity agreement with the Banks, promising no other bar or restaurant would have a similar concept. In the agreement, Toby Keith's I Love This Bar & Grill would be the only "first class county music themed restaurant and lounge offering live music and serving a variety of food and beverages."

The lawyer stated that his client felt that some of the tenants at The Banks have similar offerings, violating their agreement.

On Tuesday, The Banks' master development team of Carter and The Dawson Company announced the lawsuit was dismissed.

"We're pleased that we could settle this before the suit moved any further," said Scott Stringer, executive vice president at Carter.

FOX19 reached out to the lawyer for Capri Concepts, LLC. on Tuesday, who also revealed the rent issue had been resolved, but couldn't get into details of the settlement.
