Judge reverses decision, allows Banis to testify

LOUISVILLE, KY (WAVE) – Another twist took place in the trial of Jeffrey Mundt on Thursday.

Judge Mitch Perry reversed his decision and will allow Joseph Banis to testify in the case.

Banis, the ex-boyfriend and co-defendant of Mundt, refused to testify on May 20 after he was denied a new trial. After a jury found Banis guilty of complicity to murder in March for the death of Jamie Carroll, he had agreed to testify against Mundt in exchange for prosecutors dropping the death penalty and recommending life with the possibility of parole in 20 years.

Thursday the judge said he would not allow Banis to testify, but after Commonwealth's Attorney Tom Wine argued denying Banis' testimony could hamper prosecuting Mundt  and may affect outcome of the case, Perry reversed his decision.

Both sides are expected to meet Friday morning before Banis takes the stand.

Mundt faces murder, robbery and tampering with evidence charges in Carroll's death.

Carroll disappeared in December 2009. His body was found six months later buried in the basement of the home Mundt shared with then boyfriend Joseph Banis after Banis was arrested during a domestic dispute between the couple.

The trial will resume Friday morning with a hearing surrounding a meeting between the prosecution and Banis earlier this week.  That begins at 9 a.m.
