Lukjan ready for 2nd trial

LOUISVILLE, KY (WAVE) - A woman convicted of burning down her business for insurance money is ready to clear her name.

On August 16, 2006, Campbell's Gourmet Cottage in St. Matthews caught fire. Its owner, Susan Lukjan was convicted in May 2010 and sentenced to 12 years in prison that July. Her conviction was overturned in January 2012, but Lukjan wants a new trial.

Lukjan and her attorney, Thomas Clay, say this trial will be different because the defense will have a chance to call experts to the stand.

"I've said it from the beginning. I'm not taking a plea under any circumstance," said Lukjan. "Like I've said all along about my kids ... It's easy to do the right thing when it's easy, but it's when it's hard that counts."

"I think our evidence is strong," said Assistant Commonwealth's Attorney Leland Hulbert. "Obviously we wouldn't proceed to trial or indict a case if we didn't think we had good evidence."

There were questions about a possible conflict of interest with Lukjan's attorneys handling both her civil and criminal cases. However, Lukjan said she wanted to keep them.
