Daycare owner where toddler died charged for benefits scheme

LOUISVILLE, KY (WAVE) - The owner of a day care where a 2-year-old died after swallowing a push pin is now accused of lying to the state to collect taxpayer money.

Katrina Clyburn is charged with 13 counts of making false statements to receive government benefits between 2009 and 2012.

An arrest warrant says Clyburn failed to report her correct income and failed to report that she owned Trina's Treehouse day care in Louisville. In all, state investigators said Clyburn collected $112,622 in food stamp, Medicaid and child care assistance money she wasn't entitled to.

The felony charges come about a year and a half after two year old Ja'Corey Davis died at Trina's Treehouse. Medical examiners found the boy swallowed a push pin that blocked his airway.

The state's preliminary finding's faulted Trina's Treehouse for "failing to assure minimum regulator staff to child ratio's." No criminal charges were filed in that case. The toddler who died was the son of Clyburn's cousin.

The Kentucky Cabinet for Health and Family Services says Trina's Treehouse was one of 18 day cares in the Louisville area that reached a settlement in 2013 with the Office of the Inspector General to avoid prosecution for problems with payout's of the state's child care assistance program, or CCAP.

CCAP is one of the program's Clyburn is now accused of over billing.

An arrest warrant was served to Clyburn's at the $433,000 home in the Polo Fields neighborhood where she has been living.
