Whitlock says he's in limits of probation

LOUISVILLE, KY (WAVE) – The date is set for a former Jefferson County constable to prove he is still within the limits of his probation.

David Whitlock took a plea deal to avoid going to trial for shooting a suspected shoplifter in 2011 and avoided jail time through a diversion program.

As a part of that deal he cannot carry a weapon, but his new business called Securus, located on Dixie Highway, provides carry and conceal weapons classes.

Whitlock said he is a silent partner in the company.

The Commonwealth's attorney said the fact Whitlock is a silent partner still breaks their agreement.

Whitlock is scheduled to be back in court on August 15 to find out if he will remain a free man or have to go to prison.
