Attorney: Mother OK with plea deal taken in son's death

LOUISVILLE, KY (WAVE) – The mother of a child who was allegedly beat to death by her boyfriend is ok with the plea deal taken by the man charged with her son's murder, according to an attorney.

Assistant Commonwealth's Attorney Chris Foster said the mother of Tony Hack, 4, was aware of the plea deal Johnny Juliot took Tuesday in which he plead guilty to the lesser charge of manslaughter.

Investigators believe Juliot was watching his girlfriend's son in December of 2010 when he hit Tony in the head so hard the boy suffered multiple skull fractures. Tony died two days later.

The plea Juliot took was an Alford plea, which means Juliot accepted there was enough evidence to convict him, but he is not admitting to the crime. Under the agreement, Juliot also pleaded guilty to criminal abuse and tampering with physical evidence. 

He was sentenced to 15 years in prison.

While at one time, the state was planning on seeking the death penalty in this case, Foster said there were concerns in the case, but would not go into detail.
