JCPS bus driver, principals named in lawsuit following alleged sexual assault

LOUISVILLE, KY (WAVE) – A mother who claims her daughter was sexually assaulted on a Jefferson County Public School bus filed a civil lawsuit on Tuesday.

According to the lawsuit, a 7th grade student who attended Lassiter Middle School was on JCPS bus number 0035 when the assault took place on March 20, 2012.

The lawsuit states six other students on the bus held the 7th grade student down, covered her eyes, tore her clothing and forcefully assaulted her.

The mother of the student filed the suit against the driver of the bus, Larry Geary, Lassiter Middle School Principal, Jonathan Cesler, Lassiter Middle School Vice Principal, Kevin Peak, and the principal of Western High School, Michael Newman, where she claims her daughter was eventually assigned to attend with one of her alleged attackers.

Prior to the alleged attack the lawsuit states one of the minors accused in the assault was with other minors in January 2012 when her daughter was pushed to the ground, kicked and had her cell phone stolen at her bus stop. The lawsuit states the mother made Cesler and Peak aware of the bus stop incident as asked them to protect her daughter.

Geary, Cesler, Peak and Newman are being sued for negligent supervision. The girl's alleged attackers are being sued for battery.
