Police made the arrest early Tuesday morning, less than 12 hours after the crime.

According to the arrest report, Tandy and another person conspired to rob Przybylek. During the robbery, the men started struggling and subsequently the victim was shot, police said.

Przybylek was pronounced dead at the scene at 6:04 p.m. as a result of the shooting, according to Jim Wesley, a Jefferson County Deputy Coroner.

Detectives said Tandy hid his weapon from police and they have not been able to recover it.

Tandy is charged with murder, robbery and tampering with physical evidence, all of which are felony charges.

Funeral arrangements for Przybylek are pending.
