Judge delays Jodi Arias' second penalty phase

The second penalty phase in the case against convicted killer Jodi Arias has been delayed.

Juan Martinez, the prosecutor in the Arias case, is prosecuting in another trial that conflicts with Arias' retrial.

Officer Anthony Holly was killed in the line of duty seven years ago. Accused killer Brian Hulsey is still awaiting trial in what is the oldest capital murder case in the county right now.

The judge in the Hulsey case said he would not delay Hulsey's trial any longer, so the judge in Arias' trial was forced to push back the retrial that was set for March 17. A new date has not been set as of Wednesday morning.

In May, Arias, 33, was convicted of murdering her ex-boyfriend, Travis Alexander, in his Mesa home, but the jury could not reach an agreement on sentencing her to life in prison or giving her the death penalty.

Under Arizona law, while her murder conviction stands, prosecutors have the option of putting on a second penalty phase with a new jury. If they fail again to reach a unanimous decision, Arias would face life behind bars or be eligible for release after 25 years.

Judge Sherry Stephens has banned live television coverage of the retrial.
