Mesa officers fire 9 rounds at man wielding handgun

Mesa police officers said they were forced to open fire at a man who wielded a handgun during a domestic dispute Tuesday night.

Witnesses said they saw a woman, later identified as Mandy Fuqua, 48, emerge from an apartment she shares with Daniel Gutierrez, 54,and hold a knife to his throat, according to a probable cause statement.

Officers were called to the Aspen Ridge apartments at 820 E. Brown Rd. about 10 p.m. and when they arrived, the couple fled back into the apartment, court paperwork stated.

As police knocked on the door, Gutierrez yelled that he would kill them, the court document stated.

Two officers prepared to kick the door open when Gutierrez walked to the kitchen window by the door and displayed a gun in what officers thought was a holster, according to the probable cause statement.

Both officers drew their handguns and Gutierrez closed the curtains. Less than 30 seconds later, Gutierrez opened the curtain and pointed the firearm at the officers, court paperwork stated.

Both officers, fearing for their lives, fired nine rounds at the man, who was not hit.

Gutierrez and Fuqua barricaded the apartment.

Police used non-lethal chemicals to end the standoff.

Gutierrez had also called police after the shooting and stated he had a gun, and would kill any officer entering the apartment, according to the probable cause statement.

A search warrant was served on the apartment and officers found the knife and firearm, which turned out to be a broken BB pistol wrapped in a cloth.
