Man convicted in crash that killed 4 boys back in custody

LOUISVILLE, KY (WAVE) – A man who was convicted of manslaughter for a crash that killed four boys was taken into custody again on Monday.

According to an arrest report, around 4:30 p.m., a police officer saw Herbert Lee, 21, driving on Broadway and began to follow him. Lee's driving privileges have been permanently suspended due to past convictions.

Officers soon discovered the car the suspect was driving was stolen. It is reported to be worth over $10,000.

As police were following Lee, they said he stopped the car, jumped out and fled on foot. Officers set up a perimeter and found the suspect hiding in the back of a parked car a few blocks away, according to the report.

Officers said they had to force Lee out of the vehicle to place him under arrest. While they were doing that, several police officers reported being bruised and scraped by the suspect.

Once he was secured in the back of a cop car, he kicked out a rear window of the vehicle and jumped to the ground while the car was moving, police said. Another struggle ensued in which the officer's shirt was ripped.

Police said Lee stated he was "being set up for killing those four kids in that one stolen car."

Damages to the officer's car totaled $500, according to the report. Also, two bags of marijuana were found inside the vehicle Lee is accused of stealing.

Lee was booked into Louisville Metro Department of Corrections at 6:45 p.m. on felony charges of assault of a police or probation officer, receiving stolen property $10,000 or more and escape and misdemeanor charges of fleeing and evading police on foot, operating on a suspended or revoked operator's license, criminal mischief, resisting arrest, possession of marijuana.

It was 2008 when, at age 16, Lee picked up twin brothers Jemar and Demar Claybrooks, also 16, their younger brother Marc, 14, and a friend, 15 year-old Aaron Shields from a Youth Alive event in a stolen car. When police tried to pull Lee over, he took off eventually crashing into a tree. All of his teenage passengers were killed.

Lee served one year in prison for manslaughter, the maximum punishment under juvenile law.

He was released from prison the first time in December 2011.

Seven months after his release, in the summer of 2012, Lee was arrested again for driving a stolen vehicle. In May 2013 Lee took a plea deal resulting in a three-year prison sentence. He was released in November 2013.
