Senate committee OKs criminal punishment for 'upskirt' photos

FRANKFORT, KY (WAVE) - A bill approved in a Kentucky Senate committee Thursday would make it a crime to take pictures up a woman's skirt without her knowledge.

The Senate Public Protection committee passed the legislation in a unanimous vote after little discussion. Two Louisville lawmakers said they were sponsoring the bill in response to a court case in Massachusetts.

Last week, a court ruled it was legal to take so-called "upskirt" photos in that state because Massachusetts law wasn't clear. Police had arrested a man for taking cell phone pictures of a woman while riding a subway.

"I saw where Massachusetts was dealing with this and in looking at our particular voyeurism law, it's not sufficient to deal with the new technology," said Sen. Julie Denton, R-Louisville.

The bill making upskirting a Class A misdemeanor in Kentucky now moves to the full Senate for consideration.
