Louisville man sentenced after admitting role in creation of child porn

LOUISVILLE, KY (WAVE) - A Louisville man was sentenced Tuesday to 27 years in prison and a lifetime of supervised release for sexually abusing a minor under the age of seven during the production of child pornography, according to U.S. Attorney David J. Hale.

According to the plea agreement, Thomas Evan Middleton, 50, admitted sexually abusing the girl during the creation of pornography while babysitting her between August 2009 and May 2011.

The Louisiana Attorney General's Office investigated the case initially and then contacted law enforcement in Louisville after executing a search warrant at the home of Louisiana resident Robert Swan on January 30, 2013. While reviewing Swan's electronic storage devices, investigators discovered images of Swan and a then-unknown individual engaged in the sexual exploitation of a minor. The unknown man had a cross tattoo on his right middle finger. He was later identified as Thomas Middleton via information located on Swan's computer.

According to Hale, during the course of the investigation, thousands of digital images of child pornography were recovered, including images showing Swan and Middleton sexually abusing a 4 or 5-year-old girl.

On July 24, 2013, a federal search warrant was executed on Middleton's home in Kentucky. A spokeswoman for the U.S. Attorney's office said several items in the residence appeared to match items shown in some of the sexual abuse images found on Swan's computer. In addition, Middleton identified the young victim shown in the pictures with him.

The case was prosecuted by Assistant U.S. Attorney A. Spencer McKiness and was investigated by the FBI with assistance from the Louisiana Attorney General's Office.
