LOUISVILLE, KY (WAVE) – Prosecutors say murder charges against Dejuan Hammond will not be dropped and the case will head to trial.

Hammond is accused of orchestrating the March 23, 2009 murder of Troya Sheckles, a key witness in the murder case against his brother, Lloyd Hammond.

Two months ago, a mistrial was declared following the discovery of evidence that was never turned over to the defense by prosecutors. The original prosecutor on the case said information was left off a police report that excluded a witness interview in the Lloyd Hammond case.

Last week, Dejuan Hammond's attorneys asked the judge to dismiss the charges against him. The judge said while the Commonwealth's Attorney's Office made a mistake, it was not intentional, so the motion to dismiss was denied.

A new trial date is expected to be set on June 23.
