JCPS student assignment plan hit with a new lawsuit

LOUISVILLE, KY (WAVE) - Jefferson County Public Schools is being hit with another lawsuit over its student assignment plan.

According to the suit, Scott Arnold's 5-year-old son applied to attend Cochrane Elementary School in Jeffersontown this fall. Instead his son is assigned to go to Engelhard Elementary in downtown Louisville, which is more than an hour away.

Attorney Teddy Gordon filed the suit in Jefferson Circuit Court on Wednesday. Gordon says the district's new student assignment plan is depriving a Jeffersontown student from attending his neighborhood school.

Gordon says the state law - KRS 159.070 - takes precedence over the district's new student assignment plan.

Byron Leet, attorney for JCPS, issued the following statement:

"JCPS attorneys have reviewed the suit and believe the student assignement plan is valid and Mr. Gordon's lawsuit will not require JCPS to change the plan."
