LOUISVILLE, KY (WAVE) - In the latest developments in the Karen Sypher extortion case, Sypher's attorney, David Nolin, filed a motion overnight requesting access to electronic information they say is relevant to her defense.
In the motion, Sypher's attorneys are asking for copies of all email and text messages sent by Rick Pitino as well as the following people connected to the case: Dana Kolter, Thomas Clay, Stephen Pence, James Earhart, Bruce A. Wyckoff, Timothy Sypher. The motion asks for copies of messages sent between August 2003 and the present.
The motion says Sypher's new attorneys discovered three boxes of "unreviewed evidence" after her former attorney, James Earhart, stopped serving as her legal counsel, and that those materials contained "emails and other materials that would lead the reviewer to conclude that a conspiracy exists between members of the Government prosecution, other Counsel for Pitino and the defendant's own attorneys."
According to the motion, Sypher's attorneys conspired to destroy and cover up evidence that the Yum! Center, University of Louisville and Adidas-Reebok conspired to silence Sypher to make sure "Pitino and Yum Center were not tarnished by a complaint of a woman."
