Grand jury hands up 2-count indictment against Carroll Co. sheriff

CARROLLTON, KY (WAVE) - A grand jury has handed up a two-count indictment against Carroll County Sheriff Jamie L. Kinman.

The grand jury alleges that between November 1 and December 31, 2013, Kinman committed the offenses of tampering with physical evidence and second-degree official misconduct.

According to the indictment, Kinman, believing that an official proceeding was pending, "destroyed, mutilated, concealed, removed or altered physical evidence, which he believed was about to be used or introduced in the official proceeding."

Kinman, Carroll County and the Carroll County Sheriff's Office are named in a civil lawsuit filed by Chief Deputy James Thomas Shaw. He claims he was the target of retaliation after reporting that drug evidence was planted in a former deputy's car.

The suit states that in November 2013, Chief Deputy Clay Cable quit his job and asked Shaw to inspect his patrol car before turning the keys over to the sheriff. Shaw says in the lawsuit that he inspected the car, and the car was clean. Days later, after being appointed Cable's replacement as chief deputy, Shaw claims the sheriff asked him to inspect Cable's car, not realizing he already had. In the lawsuit, Shaw claims the second search turned up a bag of prescription pills, which he says he recognized as evidence from a criminal case he investigated and logged.

Shaw says he confronted the sheriff about the drugs and talked to Kentucky State Police, which began investigating.

Shaw's lawsuit claims that Kinman then started to retaliate against him, changing Shaw's shift, sending him all over the state and causing him to suffer severe emotional distress. Shaw went on an extended medical leave in June 2014.
