Fight inside business leads to gunfire; 1 round strikes nearby home

LOUISVILLE, KY (WAVE) - A man wanted for firing a gun during a confrontation with another man inside a store has been arrested.

Nickolas Lavely, 19, of Louisville, was taken into custody April 14 at the Hall of Justice by the Jefferson County Sheriff's Office. A warrant for Lavely had been issued on January 15.

Louisville Metro police said Lavely was inside CAPS Food Mart & Deli at 1506 S. Shelby on the night of January 8 when he got into argument with a man at the counter. Other man punched Lavely in the face knocking him to the ground.

The warrant says Lavely's brother then began fighting with the man and Lavely pulled out a .380 handgun and started waving it around. Lavely fired a shot hitting the bottom of the entry door to the store.

When the man who hit him ran out of the store Lavely chased after him firing five more shots. One bullet went into the kitchen of a nearby home several feet from the spot where an 11 year old was standing. Police say the bullet lodged in an interior wall.

Lavely is being held without bond on five counts of wanton endangerment. He will be back in court April 25.
