LOUISVILLE, KY (WAVE) - We're getting a deeper look at what may have lead to a fight in the Germantown area back in September. The fight quickly turned into a murder investigation for police.
Gary Muncy bonded out of jail just days after that fight at the Schnitzelburg walk.
The discovery in the case contains hundreds of pages of evidence and lengthy police interviews. WAVE 3 was able to go through some of that evidence Tuesday.
Gary Muncy sat down with investigators from LMPD, detailing his side of what happened on September 25th near East Burnett and Hickory street.
"What basically started one of the guys had been harassing my cousin," said Muncy. "She is deaf. The guy had been saying I've been watching you."
It all went down at the Schnitzelburg walk. Muncy says in the police interview he was attending the event with his family and girlfriend. Muncy says two men were bothering his cousin.
"I see my mom talking to two guys, pointing her finger," said Muncy.
An altercation police say led Muncy to punch 38-year old Donald Smith Jr. Muncy was initially charged with assault. His charge was upgraded to murder after Smith died at U of L hospital from a traumatic brain injury.
A police document says Smith his head on a curb and began to choke on the chewing tobacco in his mouth.
"He comes towards me and I push him and he came at me again and I pushed him back," said Muncy. "Well, the third time I hit him. I think I hit him twice."
A picture of Muncy's injured hand was in the case file. Which also includes countless text messages, witness interviews, and court documents from the investigation.
There are hours of police interview as well as documents WAVE 3 is going to continue to dig through and will try to bring you more on this story in the coming days.
Muncy will be back in court November 14th.
